VAT Advice That Connects the Rules to Your Business Records

The UAE standard VAT rate is 5%, but a business cannot determine every VAT obligation simply by applying that rate to its sales. Some supplies may be zero-rated or exempt. Others raise questions about the place of supply, imports, reverse charge treatment, input tax recovery or the supporting documents needed to justify a position.

Registration also creates continuing responsibilities. A VAT-registered business needs a workable process for issuing and retaining appropriate invoices, recording taxable transactions, reconciling its figures, submitting returns and paying any tax due. When the accounting records and VAT treatment diverge, the difference should be understood before it flows into a return or an FTA response.

XFLEX provides VAT consultancy for these practical decisions. We review the relevant facts, identify the records needed, explain the applicable considerations and set out proportionate next steps within the agreed engagement.

Our UAE VAT Consultancy Services

The exact work depends on the business, its registration status and the transactions under review. An engagement may cover one defined issue or a broader review of VAT processes and records.

VAT Registration and Deregistration

Assess whether a registration threshold has been met, identify the supporting figures and documents, review the proposed application information and consider deregistration where business circumstances have changed.

VAT Return Preparation and Review

Organise return data, examine sales and purchase summaries, review reconciliations and investigate material differences between accounting records and the proposed VAT return before submission.

Transaction and Supply Reviews

Analyse the VAT treatment of selected sales, purchases, imports, cross-border transactions or unusual arrangements based on the contracts, invoices and transaction flow available.

Tax Invoices and Record Controls

Review selected invoices, credit notes and supporting records to identify documentation gaps, inconsistent treatment and areas where internal processes need clearer controls.

Input Tax and Refund Reviews

Examine potential input tax recovery or refund positions against the applicable conditions, purchase documentation and the business purpose of the expenditure.

FTA Correspondence and Audit Readiness

Help organise records, reconcile figures and prepare technical background for VAT-related FTA questions, notices or audit requests within the confirmed professional scope.

VAT Registration: When a Threshold Is More Than a Sales Figure

A UAE-resident business is generally required to register when the total value of its taxable supplies and imports exceeds AED 375,000 over the previous 12 months, or is expected to exceed that amount within the next 30 days. A resident business making taxable supplies may generally be eligible for voluntary registration when its taxable supplies, imports or taxable expenses exceed AED 187,500 over the relevant previous 12-month or expected next 30-day period.

The assessment requires more than checking annual turnover in a financial statement. Businesses should identify which supplies and imports count, establish the relevant dates, retain evidence for forecasts and consider whether separate activities belong to the same taxable person. Non-resident businesses can be subject to different registration requirements.

Once a person becomes required to register, the FTA states that the application must be submitted within 30 days. Early review matters because a registration analysis may involve historic transactions, forecasts and records that take time to assemble.

Free zone businesses: Establishment in a free zone does not automatically remove VAT obligations. Registration and transaction treatment depend on the business activity, the nature of its supplies and any relevant designated zone provisions.

VAT Returns Should Be Supported by Reconciled Figures

The FTA states that a registered person generally files its VAT return and makes the related payment within 28 days after the end of its tax period. The assigned tax period and applicable due date should be checked in the taxpayer’s FTA account and current official guidance.

A VAT return is the result of several earlier decisions: how transactions were classified, whether invoices were issued correctly, which purchases support input tax recovery and whether accounting adjustments were reflected in the correct period. Reviewing only the final return fields may leave underlying differences unresolved.

Review area Practical question Typical supporting material
Sales and output tax Do the reported supplies agree with the sales records and the treatment applied? Sales ledger, tax invoices, credit notes and contracts.
Purchases and input tax Is claimed input tax supported and subject to the applicable recovery rules? Purchase ledger, supplier tax invoices and expense records.
Imports and cross-border activity Were import and relevant reverse charge entries considered correctly? Customs documents, supplier invoices and transaction details.
Adjustments and differences Are credit notes, corrections and material ledger differences understood? Reconciliation schedules, adjustment entries and prior returns.

XFLEX can prepare and review return information, investigate selected differences and help establish a clearer review process. The business remains responsible for accurate information and timely compliance; any formal filing role is confirmed in the engagement.

VAT Questions That Benefit from a Transaction-Level Review

A useful VAT opinion starts with what happened in the transaction, who the parties were and which documents support the position.

Zero-Rated and Exempt Supplies

These categories do not have identical consequences. We review the nature of the supply and relevant evidence before a business relies on a particular treatment, including its effect on related input tax considerations.

Imports and Cross-Border Transactions

Goods movements and services involving overseas parties can raise questions about the place of supply, import records and reverse charge treatment. The commercial and documentary facts need to be considered together.

Free Zones and Designated Zones

The VAT position depends on the relevant zone rules and the nature and movement of the goods or services. A free zone address alone is not enough to determine the treatment.

Input Tax Recovery

A purchase invoice is an important part of the evidence but does not, by itself, establish that every amount is recoverable. The applicable rules, business use and records must be examined.

What to Prepare for a VAT Review

The document request should match the issue. A registration question may need turnover calculations and contracts; a return review may need ledgers and prior filings; a transaction question may turn on the agreement, invoice and actual flow of goods or services.

  • Trade licence, entity information and existing Tax Registration Number, if applicable.
  • Relevant VAT registration details and prior returns.
  • Sales and purchase ledgers for the periods under review.
  • Tax invoices, credit notes and material transaction contracts.
  • Import or customs records where relevant.
  • VAT account reconciliations and explanations for adjustments.
  • FTA correspondence or notices relating to the matter.

We identify missing evidence before relying on a proposed treatment or preparing a response. The availability and quality of the records affect what conclusions can reasonably be reached.

How XFLEX Approaches a VAT Engagement

  1. Define the question

Confirm the business activities, VAT status, transaction or compliance concern, relevant periods and intended deliverable.

  2. Review the evidence

Examine the available records and identify gaps that could affect the analysis or a formal submission.

  3. Analyse the VAT position

Assess the applicable treatment using the relevant UAE VAT legislation and current FTA guidance.

  4. Set out practical actions

Explain findings, outstanding questions, documentation needs and the next steps agreed with the business.

  5. Prepare for implementation

Support adjustments to records, return preparation or an application within the confirmed engagement scope.

  6. Confirm formal responsibilities

Identify who is responsible for approval, filing, payment and any authorised communication with the FTA.

Possible Deliverables

Depending on the agreed scope, the work may result in a registration assessment, document request, VAT treatment note, return review comments, reconciliation schedule, transaction testing summary or action list for the finance team.

Where an issue requires additional facts, specialist legal input or a formal tax authority process, we identify that requirement as part of the next steps. A conclusion is limited to the information reviewed and the scope agreed for the engagement.

Tax Advisory, Filing and Representation: Clear Roles

XFLEX provides VAT advisory, accounting and financial support within the agreed scope. A business may submit its own VAT filings through its authorised users. Where representation before the Federal Tax Authority is required, that role is undertaken by a duly appointed UAE Registered Tax Agent within the terms of the appointment.

Legal advice and representation in court proceedings require separately authorised legal counsel. XFLEX does not present tax advisory or financial support as legal representation.

XFLEX is led by Dr. Ebrahim Al Ali, Founder & Managing Director, who oversees the firm’s engagements and works with qualified professionals across financial, forensic and dispute-related matters.

Engagement limits: The outcome of a VAT registration application, refund request, FTA review or other tax process depends on the applicable rules, the facts and the Authority’s decision. No particular outcome is guaranteed.

Some VAT matters connect to wider tax obligations, FTA communication or audit preparation. The following services address those separate needs.

When must a UAE-resident business register for VAT?

A resident business making taxable supplies may generally apply when taxable supplies, imports or taxable expenses exceed AED 187,500 over the previous 12 months or are expected to exceed that amount within the next 30 days.

Relevant material can include sales and purchase ledgers, tax invoices, credit notes, import documents, reconciliations, prior returns and records explaining material adjustments.

Can XFLEX prepare or file VAT returns?

XFLEX can support the preparation and review of return information. The business’s authorised users may submit its filings. Any filing assistance or formal FTA representation is confirmed in the engagement and carried out within the applicable authorisations.

Can XFLEX guarantee a VAT refund or FTA approval?

No. Eligibility and outcomes depend on the legislation, the facts, supporting evidence and the FTA’s assessment. XFLEX can review documentation and explain the steps relevant to the agreed scope.

Does XFLEX provide legal representation in VAT disputes?

XFLEX provides tax advisory and financial support. Representation before the FTA, where required, is handled by a duly appointed UAE Registered Tax Agent. Court representation and legal advice require separately authorised legal counsel.
